Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs the use of services provided by Dharmendra Asimi under the trade name Aapta Solutions through dharmendraasimi.com. This policy applies to all clients using our WordPress Maintenance Plans, Consulting Services, and On-Demand Services.
By using our services, you agree to comply with this AUP in addition to our Terms and Conditions. Violations may result in suspension or termination of services.
1. General Conduct
You agree to use our services in a lawful, ethical, and responsible manner. You shall not use our services to:
- Violate any local, state, national, or international law or regulation.
- Infringe upon the intellectual property rights of any third party.
- Engage in fraudulent, deceptive, or misleading activities.
- Harass, threaten, defame, or discriminate against any person or group.
- Interfere with or disrupt the integrity or performance of our services or third-party systems.
2. Prohibited Content
Your website or any content managed through our services must not contain or promote:
- Illegal Content: Content that violates any applicable law, including but not limited to content related to illegal drugs, weapons trafficking, human trafficking, or terrorism.
- Malware and Malicious Code: Viruses, trojans, ransomware, spyware, adware, cryptominers, or any software designed to harm, exploit, or gain unauthorized access to systems.
- Phishing and Scams: Websites or content designed to deceive users into providing personal information, credentials, or financial data.
- Hate Speech: Content that promotes hatred, violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
- Child Exploitation: Any content that exploits or endangers minors, including child sexual abuse material (CSAM).
- Pirated Content: Unauthorized distribution of copyrighted material, including software, music, movies, books, or images.
- Spam and Bulk Messaging: Content or services designed to send unsolicited bulk emails, SMS, or messages.
- Counterfeit Goods: Websites selling or promoting counterfeit or knockoff products.
- Adult Content: Pornographic or sexually explicit material (unless explicitly agreed upon in writing as part of a legitimate adult content business with appropriate age verification).
3. Website Security
You agree to:
- Maintain strong, unique passwords for all WordPress and hosting accounts.
- Not share credentials with unauthorized parties.
- Notify us immediately if you suspect unauthorized access to your website or accounts.
- Not intentionally introduce vulnerabilities, backdoors, or security weaknesses.
- Cooperate with us in resolving security incidents promptly.
- Not use your website to launch attacks against other websites, servers, or networks (e.g., DDoS attacks, port scanning, brute-force attempts).
4. Resource Usage
For clients on our Maintenance Plans:
- Developer Hours: Developer time must be used for legitimate website-related tasks. Hours cannot be used for projects unrelated to the maintained website.
- Scope of Work: Requests outside the defined scope of your plan will be quoted separately and require separate agreement.
- Reasonable Use: Support requests and developer time should be used reasonably. Excessive or abusive use of support channels may be addressed on a case-by-case basis.
- Fair Use of Backups: While we offer unlimited restores, this is intended for genuine recovery needs and not as a substitute for proper development workflows (e.g., repeatedly restoring to test changes).
5. Email and Communication
If SMTP or email services are configured as part of your maintenance plan:
- You must not use email services to send spam, bulk unsolicited emails, or phishing messages.
- All email communications must comply with applicable anti-spam laws (CAN-SPAM Act, GDPR, Indian IT Act).
- Email lists must be opt-in only with proper consent documentation.
- Unsubscribe mechanisms must be honored within 10 business days.
- SPF, DKIM, and DMARC records configured by us must not be modified without consultation.
6. SEO and Marketing Practices
If SEO or marketing services are part of your engagement:
- You must not engage in black-hat SEO practices including keyword stuffing, cloaking, hidden text, link schemes, or automated link building.
- Content must be original or properly licensed. Plagiarized content is prohibited.
- Paid advertising campaigns must comply with the respective platform's advertising policies (Google, Facebook, LinkedIn, etc.).
- Marketing claims must be truthful, substantiated, and not misleading.
7. Third-Party Services and Integrations
- You are responsible for compliance with the terms of service of any third-party plugins, themes, APIs, or services used on your website.
- Nulled or pirated plugins and themes must not be installed on websites under our management. If found, they will be removed immediately.
- API keys and third-party credentials shared with us must be legitimate and properly licensed.
8. Data and Privacy
- You are responsible for ensuring your website complies with applicable data protection laws (GDPR, DPDPA, CCPA, etc.).
- If your website collects personal data, you must have appropriate privacy policies, consent mechanisms, and data processing agreements in place.
- We will assist with cookie consent setup and basic ADA/accessibility compliance checks (included in Advanced plan), but ultimate compliance responsibility rests with you.
9. Cooperation and Access
- You must provide timely access to your website and hosting environment as needed for service delivery.
- Changes to hosting providers, domain registrars, DNS settings, or server configurations should be communicated to us in advance.
- If you or a third party makes changes to your website that conflict with our maintenance work, we must be notified promptly to avoid service disruptions.
10. Reporting Violations
If you become aware of any violation of this AUP — whether by yourself, a user of your website, or a third party — you must notify us immediately at contact@dharmendraasimi.com.
11. Enforcement
Violations of this AUP may result in:
- Warning: A written notice identifying the violation and requesting corrective action within a specified timeframe.
- Service Suspension: Temporary suspension of services until the violation is resolved.
- Service Termination: Permanent termination of services for severe or repeated violations, with no refund for the current billing period.
- Legal Action: In cases of illegal activity, we may report violations to appropriate law enforcement authorities.
We reserve the right to take immediate action (including suspension without prior notice) in cases where a violation poses an immediate risk to security, legal compliance, or third-party rights.
12. Changes to This Policy
We may update this AUP from time to time. Changes will be communicated via email or notice on the Website. Continued use of our services after changes constitutes acceptance.
